Do we think that the Legal Services Commission is a competent organisation for the Law Society to be negotiating with. That organisation has proved itself yet again to be totally incompetent to manage such an important public service. The result has been that of 2400 firms providing family legal services countrywide only about 1300 have been offered contracts.
We are all aware of the need to use resources constructively and not only in the current climate. The way in which this is being done will, however, have three disastrous consequences.
1. Cutting the service supply in half is disproportionate to the real community need for advice in family law, including questions about the protection of children.
2. The arbitrary way in which the cull has been undertaken will lead (and may already have done so) to the loss of many experienced practitioners.
3. Immediately there will be an effect on the conduct of proceedings involving children, because their representation may be withdrawn without any prospect of finding representation elsewhere. The Legal Services Commission in its tendering process made no effort to see whether this would create problems.
